Terms of Use for Information Requesters

1. Scope and Role of Whistle42

Whistle42 is a whistleblower and intelligence platform operated within the CyTel42 group. We provide a structured way for information requesters to publish targeted calls for information to our community and analysis team.

We are not a law firm, public authority or investigative agency and do not provide legal advice or official decisions. All services are provided on a best-effort, information-only basis.

2. Eligibility and Lawful Use

You may use the Information Request Platform only if:

• you act in your own name or with proper authorisation on behalf of an organisation, and
• you use the service only for legitimate, lawful purposes.

You must not use the platform to pursue unlawful objectives, to harass individuals, to obtain protected state secrets, or to solicit information that you are not legally entitled to receive.

3. Service Description and No Guarantee of Results

After you submit a request, our team reviews it for compatibility with our ethical guidelines, whistleblower protection rules and data protection obligations. We may:

• approve the request and propose a suitable package and fee,
• suggest modifications to narrow or clarify your request, or
• reject the request at our sole discretion.

If a request is accepted and a package is agreed, we will list and/or promote your request as described. However, we do not guarantee that:

• whistleblowers or community members will respond to your request,
• responses will be complete, accurate or usable for your purpose, or
• any specific outcome (e.g. enforcement action, litigation success) will occur.

Any use of information you receive via Whistle42 is at your own risk and responsibility.

4. Fees, Invoicing and Payments

The fee schedule shown on the Information Request page is indicative only. Final pricing, scope and deliverables will be confirmed in writing (for example by email or proposal) before we start work on your request.

Fees are normally invoiced in EUR and subject to applicable VAT. We may request advance payment in full or in part before activating your request.

5. Whistleblower Protection and Confidentiality

Our first priority is to protect whistleblowers and individuals who share information in good faith. For this reason:

• we may anonymise, summarise or withhold sensitive details,
• we may refuse to pass on information that could identify whistleblowers without their consent, and
• we may refuse requests that could expose whistleblowers or other individuals to undue risk.

You agree to treat any information obtained via Whistle42 confidentially and use it only for legitimate purposes in line with applicable law.

6. Data Protection

We process your personal data in accordance with our Privacy Policy. By submitting a request, you confirm that you have read and understood the Privacy Policy and that you are authorised to provide any personal data contained in your request.

7. Liability

We are liable only for damages caused by intent or gross negligence, and for any mandatory liability under applicable law (for example product liability or injury to life, body or health).

To the extent permitted by law, our liability for slight negligence is excluded. In any case, our aggregate liability towards you arising from paid services under these Terms is limited to the amount of fees actually paid by you for the respective information request.

8. Relationship to C42 Tokens

The Information Request Platform is a paid service. Any use or holding of C42 or C42S tokens is governed by separate program terms and offering documents and is not required to submit an information request. These Terms of Use do not constitute an offer or invitation to acquire any token and do not form part of any token-related documentation.

9. Changes and Governing Law

We may update these Terms of Use from time to time. The version published on this page at the time of your request applies to your use of the platform.

Unless otherwise stated in our imprint, these Terms are subject to the laws of the jurisdiction where the operating CyTel42 entity is registered, without regard to conflict-of-law rules.
